Anthony Lo Surdo SC FCIArb has been reappointed by the International Council of Arbitration for Sport as a member of the Court of Arbitration for Sport (CAS) for the period 2023-2026 on the CAS general list, the CAS football list and the CAS mediator’s list.

IMI Re-Accreditation

Anthony Lo Surdo SC has recently been re-accredited as an International Mediator by the International Mediation Institute (“IMI”). As part of that process, he obtained feedback from participants at no less than 10 mediations which he recently conducted which were submitted to an independent reviewer for analysis.

The latest review is as follows:

“I was provided with 13 feedback forms from 1 x Barrister and 12 x Solicitors who had represented parties for whom Mr Lo Surdo acted as Mediator, mostly in early to mid-2022. Two Solicitors offered comments relating to ‘several’ mediations Mr Lo Surdo had conducted (without mentioning the specific number of mediations they were referring to).

The feedback demonstrated Mr Lo Surdo had provided mediation services for a range of complex disputes (relating to commercial, family, negligence, property and Supreme Court matters). It is evident that Mr Lo Surdo is highly regarded in the legal industry for his strong facilitation and communication skills and his extensive knowledge and experience.

Every Reviewer stated they would recommended his services to others based on their assessment of Mr Lo Surdo’s professional character, the fair, effective and efficient process he adopts and the successful outcomes he had been able to achieve.

The Reviewers appreciated Mr Lo Surdo’s ability to assist parties to broaden their perspectives before leading them to narrow their focus on the real issues within the dispute and adopt a ‘negotiation mindset’. A number of Reviewers commented on Mr Lo Surdo’s successful style which was able to maintain the negotiation momentum via robust and relevant discussions and stimulate problem solving and option generation.

While the majority of Reviewers believed Mr Lo Surdo was able to assist the parties to appreciate the strengths and weaknesses of their cases without imposing his judgement, three of the Reviewers expressed their style preference for Mr Lo Surdo to be more forceful in the manner by which he expressed his views and challenged parties, particularly in relation to the weak points of their argument.

Overall, Mr Lo Surdo was described as highly professional, detailed and well prepared, empathetic, calm and well measured.”

Australia’s accession to the Singapore Convention on Mediation

On 10 September 2021, Australia acceded to the Singapore Convention on Mediation, the 55th member State to do so.

On 7 October 2021, Anthony Lo Surdo SC spoke on a distinguished panel of leading Australian mediators including Campbell Bridge SC, William Lye OAM QC and Alistair Wyvill SC in a seminar hosted by William Forster Chambers, Darwin, on what Australia’s accession to the Singapore Convention on Mediation means for lawyers and mediators.

Anthony Lo Surdo SC is honoured to have been appointed by Senator the Hon. Richard Colbeck, the Federal Minister for Youth and Sport as one of the inaugural members (part-time) of the National Sports Tribunal which commenced operations on 19 March 2020. It aims to provide for ‘… an effective, efficient, independent, transparent and specialist tribunal for the fair hearing and resolution of sporting disputes’ for the Australian sporting community. It provides an opt-in system of resolution of certain sports and sports-related disputes by arbitration, mediation, conciliation and case appraisal.

Federal Court Casenotes, November 2020

Anthony Lo Surdo SC and 12 Wentworth Selborne Chambers colleague Theresa Power have been retained to co-author the Federal Court Casenotes. His Honour Deputy Chief Justice Kandakasi in his capacity as Judge Administrator of the ADR Track of the National Court of Justice of Papua New Guinea, has approved the professional credentials of Anthony Lo Surdo SC, FCIArb as an International Arbitrator. Mr Lo Surdo SC has now joined the Court’s ADR Service’s Register of International and Domestic Arbitrators. Mr Lo Surdo’s appointment is a well-deserved recognition of his experience, standing and repute as an international arbitrator.

National Sports Tribunal, March 2020

Anthony Lo Surdo SC is honoured to have been appointed by Senator the Hon. Richard Colbeck, the Federal Minister for Youth and Sport as one of the inaugural members (part-time) of the National Sports Tribunal which commenced operations on 19 March 2020. It aims to provide for ‘… an effective, efficient, independent, transparent and specialist tribunal for the fair hearing and resolution of sporting disputes’ for the Australian sporting community. It provides an opt-in system of resolution of certain sports and sports-related disputes by arbitration, mediation, conciliation and case appraisal.

Mediation demand driven by client enthusiasm

Corporate clients are increasingly embracing mediation as a method of dispute resolution, prompting lawyers to follow suit, one barrister has said. Speaking with Lawyers Weekly, Anthony Lo Surdo SC of 12 Wentworth Selborne Chambers said there has been a significant change in the way mediation is viewed in the business world. “Mediation was initially something the courts were imposing upon the parties, partly to address the backlog in the resolution of civil matters,” he said. In recent years, however, the business community has seen first-hand the benefits of having disputes resolved expeditiously in mediation, Mr Lo Surdo continued. “When I first did my mediation training in 1993, it wasn’t something that was universally embraced,” he said.
